Welcome to Pierce Energy Planning, and any other web sites, applications, or services that link to this Privacy Policy (collectively, the “Service”), which sites, applications or services are operated or produced by Pierce Energy Planning (“energyplanning.org”). Pierce Energy Planning values the privacy of the users, subscribers, publishers, members, and others who visit and use the Service (collectively or individually, “You” or “Users”) and wants you to be familiar with how we collect, use and disclose information from and about you.

This Privacy Policy applies to Pierce Energy Planning's collection and use of your personal information (i.e., information that identifies a specific person, such as full name or email address). It also describes generally Pierce Energy Planning's practices for handling non-personal information (for example, interests, demographics and services usage).

By using the Service, you expressly consent to the information handling practices described in this notice.

1           The Information Pierce Energy Planning Collects

1.1        User-provided Information: You may provide to Pierce Energy Planning what is generally called “personally identifiable” information (such as your name and email address) if you register for the Service, or otherwise use the features and functionality of the Service.

1.2        “Cookies” Information: When you access the Service, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. Pierce Energy Planning may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Persistent cookies can be removed. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. We may also use Adobe Flash cookies, such as where we use Flash to provide video content. The Adobe Flash Player is an application and web tool that allows rapid development of dynamic content. Flash (and similar applications) use technology to remember settings, preferences and usage similar to browser cookies but these are managed through a different interface than the one provided by your web browser. You may manage or remove such cookies by accessing your Flash management tools available at Adobe’s website. Please note that by blocking any or all cookies you may not have access to certain features, content or personalization available through the Service.

1.3        “Automatically Collected” Information: When you access the Service or open one of our HTML emails, we may automatically record certain information from your system by using different types of tracking technology. This “automatically collected” information may include Internet Protocol address (“IP Address”), a unique user ID, version of software installed, system type, the content and pages that you access on the Service, and the dates and times that you visit the Service.

1.4        Information from Other Sources: We may obtain information, including personally identifiable information, from third parties and sources other than the Service, such as advertisers or social media networks for which you have approved our access to information (e.g., information from your Facebook account provided by the Facebook APIs). When you access the Service through social media networks or when you connect the Service to social media networks, you are authorizing Pierce Energy Planning to collect, store and use such information and content in accordance with this Privacy Policy. If we combine or associate information from such other sources with personally identifiable information that we collect through the Service, we will treat the combined information as personally identifiable information in accordance with this Privacy Policy.

2           The Way Pierce Energy Planning Uses Information

2.1        Operation of the Service. Pierce Energy Planning uses the information that you provide or that we collect from you: to operate, maintain, enhance, and provide all of the features and services found on the Service; to improve your experience with the Service by delivering content you will find relevant and interesting, including advertising and marketing messages; to allow you to comment on content; and as necessary to comply as a service provider with the Digital Millennium Copyright Act. Pierce Energy Planning uses all of the information that we collect to understand the usage trends and preferences of our Users, to improve the way the Service works and looks, and to create new features and functionality.

2.2        Email. We will use your email address, without further consent, for administrative communications such as notifying you of major Service updates, for customer service purposes, to address copyright infringement or defamation issues, or to contact you regarding any content that you have posted to or downloaded from the Service.

2.3        Marketing. Pierce Energy Planning may periodically send marketing materials or notifications to you related to the Service. If you want to stop receiving marketing materials, you can follow the unsubscribe instructions at the bottom of each email.

2.4        Use of the Information. Pierce Energy Planning may use “Automatically Collected” information and “Cookies” information to: (a) automatically update the Pierce Energy Planning application on your system; (b) remember your information so that you will not have to re-enter it during your visit or the next time you access the Service; (c) provide customized third-party advertisements, content and information; (d) monitor the effectiveness of third-party marketing campaigns; (e) monitor aggregate site usage metrics such as total number of visitors and pages accessed; and (f) track your entries, submissions, and status in any promotions or other activities.

3           When Pierce Energy Planning Discloses Information

3.1        Personally Identifiable Information. Pierce Energy Planning does not share your personally identifiable information with other organizations for their marketing or promotional uses without your prior express consent. Please be aware, however, that any personally identifiable information that you voluntarily choose to display on any publicly available portion of the Service – such as when you publish content, comments or profile information – becomes publicly available and may be collected and used by others without restriction.

3.2        Non-Identifiable Information. Pierce Energy Planning may disclose Automatically Collected and other aggregate non-personally-identifiable information with interested third parties to assist such parties in understanding the usage and demographic patterns for certain programs, content, services, advertisements, promotions, or other functionality of Pierce Energy Planning and its websites.

3.3        Limited Operational Sharing. We may disclose some limited User information to affiliated companies or other businesses or persons to: provide web site hosting, maintenance, and security services; fulfill orders; conduct data analysis and create reports; offer certain functionality; and assist Pierce Energy Planning in improving the Service and creating new services & features. We require that these parties process such information in compliance with this Privacy Policy, we authorize only a limited use of such information, and we require these parties to use reasonable confidentiality measures.

3.4        Legal Requirements. Pierce Energy Planning may disclose User information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law) or respond to a court order, judicial or other government subpoena, or warrant in the manner required by the requesting entity.

3.5        Protection of Pierce Energy Planning. Pierce Energy Planning also reserves the right to disclose User information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect Pierce Energy Planning from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Service; or to protect the rights, property, or personal safety of Pierce Energy Planning, our Users, or others.

4           Your Choices

4.1        Your Choices. You may, of course, decline to share your personally-identifiable information with Pierce Energy Planning, in which case Pierce Energy Planning will not be able to provide to you some of the features and functionality found on the Service. If you would like to access, review, correct, update, suppress, or otherwise limit our use of your personal information you have previously provided directly to us, you may contact us as outlined in the last section of this Privacy Policy titled “Pierce Energy Planning Contact Information” ; or using the mechanism provided below. In your request, please include your email address, name, address, and telephone number and specify clearly what information you would like to access, change, update, or suppress. We will try to comply with your request as soon as reasonably practicable.

4.2        Your Responsibilities. To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

4.3        Your Privacy. You should always consider your privacy settings before sharing information on Pierce Energy Planning.

5           Advertisers

5.1        Advertising Information. Pierce Energy Planning may allow advertisers, third-party advertising networks and third-party advertising serving companies to serve advertisements directly to you within the Service and other Pierce Energy Planning sites, services and software. By serving these advertisements directly to you, these companies can set their own cookies on your computer and trigger their own Web beacons and other tracking technologies to measure the effectiveness of their advertisements, and to collect and track information such as demographic information, inferred interests, aggregated information, and activity to assist them in personalizing the advertising content delivered to you. Pierce Energy Planning does not provide your personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks Pierce Energy Planning to show an advertisement to a certain audience (for example, males age 24 to 30) or audience segment (for example, males age 24 to 30 who have participated in certain promotions) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience that they were trying to reach.

5.2        Google Analytics. Pierce Energy Planning uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

5.3        Pierce Energy Planning does not Control the Advertisers. This Privacy Policy does not apply to, and we cannot control the tracking technologies and activities of, such other advertisers, third-party advertising networks, or third-party advertising servers. You should consult the respective privacy policies of these advertisers, third-party advertising networks, or third-party advertising servers. 6           Our Commitment to Data Security

6.1        Our Security Efforts. Pierce Energy Planning uses certain physical, managerial, and technical measures designed to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Pierce Energy Planning, and you do so at your own risk. Once we receive your transmission of information, Pierce Energy Planning makes efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

6.2        Notice of Breaches. If Pierce Energy Planning learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Pierce Energy Planning may post a notice on the Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. 7           Our Commitment to Children’s Privacy

7.1        Under 13 Years Old. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SERVICE AT ANY TIME OR IN ANY MANNER. Protecting the privacy of young children is especially important. For that reason, Pierce Energy Planning does not knowingly collect or maintain personally identifiable information from persons under 13 years-of-age. If Pierce Energy Planning learns that personally-identifiable information of persons less than 13-years-of-age has been collected on or through the Service, then Pierce Energy Planning will take the appropriate steps to delete this information.

7.2        Parents. If you are the parent or legal guardian of a child under 13 who has become a Pierce Energy Planning Service member, then please contact Pierce Energy Planning at info@energyplanning.org to have that child’s information deleted.

8           International Visitors

For Users visiting the Service from outside the United States of America, please note that any data you enter into the Service may be transferred outside your country for use by Pierce Energy Planning and its affiliates for any of the purposes described herein. In addition, because Pierce Energy Planning operates globally, we may make information we gather available to worldwide business units and affiliates. By providing any data on the Service, you hereby expressly consent to such transfers of your data.

Pierce Energy Planning provides some of its services to users in the EU.

Personally Identifiable Information”. For users located in the EU, references to “personal identifiable information” in this policy are equivalent to what is commonly referred to as “personal data” in the EU.

Accessing and correcting your personal data. You have the right to access and correct the personal information that Pierce Energy Planning holds about you. This right may be exercised by emailing info@energyplanning.org.

About IP addresses. Our servers record the incoming IP addresses of visitors to our websites and store the IP addresses in log files. We use these log files for purposes such as system administration and maintenance, record keeping, tracking referring web sites, inferring your location, and security purposes (e.g. controlling abuse, spam and DDOS attacks). We also store IP addresses along with certain actions you take on our system. By agreeing to this privacy policy, you expressly consent to Pierce Energy Planning using your IP address for the foregoing purposes.

9           In the Event of Merger or Sale

In the event that Pierce Energy Planning or assets related to the Service are acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from Users as part of that merger, acquisition, sale, or other change of control.

10         Changes and Updates to this Privacy Policy

This Privacy Policy may be revised periodically by posting changes on our website and by (optionally) requiring a “click through” review by you, and this will be reflected by a “last modified” date above. Please revisit this page to stay aware of any changes. In general, we only use your personal information in the manner described in the Privacy Policy in effect when we received that personal information. Your continued use of the Service constitutes your agreement to this Privacy Policy and any future revisions. For revisions to this Privacy Policy that may be materially less restrictive on our use or disclosure of personal information you have provided to us, we will make reasonable efforts to notify you and obtain your consent before implementing revisions with respect to such information.
